Welcome to RainVPN. These Terms of Service ("Terms") govern your access to and use of our VPN (Virtual Private Network) service. By creating an account, subscribing to our service, or using RainVPN in any way, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our service. We may update these Terms from time to time, and your continued use of the service after changes are posted constitutes acceptance of the updated Terms.

• "Service" or "RainVPN" refers to our VPN service, software, applications, and related services.
• "We", "Us", or "Our" refers to RainVPN and its operators.
• "You" or "User" refers to any individual or entity using our Service.
• "Account" refers to your registered user account with RainVPN.
• "Subscription" refers to your paid access plan (Basic, Pro, or Enterprise).

RainVPN provides VPN services that encrypt your internet connection and route it through secure servers. Our Service includes:

• Encrypted internet connection through our privacy-focused server network
• Access to servers in privacy-friendly jurisdictions (currently Reykjavik, Iceland)
• Multi-device support (limits vary by plan)
• Unlimited bandwidth (subject to fair use)
• Kill Switch protection
• No-logs policy (as detailed in our Privacy Policy)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

You agree to use RainVPN only for lawful purposes and in accordance with these Terms. You are responsible for all activities that occur under your Account.

Violation of this Acceptable Use Policy may result in immediate termination of your Account without refund.

Account Creation: You must provide accurate and complete information when creating an Account. You are responsible for maintaining the confidentiality of your Account credentials.

Age Requirements: You must be at least 18 years old to use RainVPN. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian.

Account Security: You are responsible for all activities that occur under your Account. Notify us immediately if you suspect unauthorized access to your Account.

Account Sharing: Your Subscription is personal to you. Sharing your Account credentials with others is prohibited and may result in termination. Device limits are enforced per plan tier (Basic: 5 devices, Pro: 10 devices, Enterprise: unlimited).

Pricing: Subscription fees are displayed on our pricing page. Prices are subject to change, but we will notify you of any changes before they take effect for your next billing cycle.

Billing Cycles: Subscriptions are billed monthly or annually, depending on your selected plan. Annual plans offer savings compared to monthly billing.

Payment Methods: We accept major credit cards, PayPal, and cryptocurrency. You authorize us to charge your selected payment method for all fees associated with your Subscription.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your Subscription at any time through your Account settings.

Refunds: Refunds are processed within 5-10 business days. Refunds are not available for partial billing periods or after the 30-day guarantee period, except as required by law.

Currency: All prices are displayed in USD unless otherwise stated. Currency conversion fees may apply for international payments.

No Uptime Guarantee: While we strive to provide reliable service, we do not guarantee uninterrupted or error-free access. The Service is provided "as-is" and "as-available."

Server Availability: Server availability may vary by location and time. We reserve the right to add, remove, or modify servers at any time.

Speed and Performance: Connection speeds depend on various factors including your internet connection, server location, and network conditions. We do not guarantee specific speeds.

Bandwidth: While we offer unlimited bandwidth, we reserve the right to implement fair use policies to prevent abuse and ensure quality service for all users.

Device Limits: Device limits are enforced per your Subscription tier. Exceeding device limits may result in connection restrictions or Account termination.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Legal Compliance: We comply with applicable data protection laws. In the event we receive a valid legal request, we will respond in accordance with applicable law and our Privacy Policy.

Our Rights: All content, software, trademarks, logos, and other intellectual property associated with RainVPN are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our express written permission.

License to Use: We grant you a limited, non-exclusive, non-transferable license to use the Service for personal or commercial use in accordance with these Terms. This license terminates upon termination of your Account.

User Content: You retain ownership of any content you transmit through the Service. By using the Service, you grant us a license to process such content as necessary to provide the Service.

No Warranties: The Service is provided "as-is" and "as-available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Damages: To the maximum extent permitted by law, RainVPN and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Maximum Liability: Our total liability to you for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or internet outages.

Termination by You: You may cancel your Subscription at any time through your Account settings. Your access will continue until the end of your current billing period.

Termination by Us: We may suspend or terminate your Account immediately, without notice or refund, if you violate these Terms, engage in prohibited activities, or for any other reason we deem necessary to protect the Service or other users.

Effect of Termination: Upon termination, your right to use the Service immediately ceases. We may delete your Account and associated data in accordance with our Privacy Policy.

Refunds Upon Termination: If we terminate your Account for violation of these Terms, you are not entitled to a refund. If you cancel within the 30-day guarantee period, you are entitled to a full refund as described in Section 6.

Governing Law: These Terms are governed by the laws of the British Virgin Islands, without regard to conflict of law principles.

Jurisdiction: Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the British Virgin Islands.

Informal Resolution: Before filing a claim, you agree to contact us to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

Class Action Waiver: You agree that any disputes will be resolved individually and not as part of a class action or representative proceeding.

Changes to Terms: We may modify these Terms at any time. Material changes will be notified via email or through the Service. Your continued use after changes constitutes acceptance.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and RainVPN regarding the Service.

Assignment: You may not assign or transfer these Terms or your Account without our written consent. We may assign these Terms without restriction.
